01Who we are and what this is
Perks is a service for running digital loyalty, membership, ticket and discount cards. Businesses manage their cards from the dashboard at perksnperks.com. Their customers collect and redeem with the Perks mobile app and an NFC tag on the counter.
These terms are the agreement between Perks (“we”, “us”) and you. Sections 2 to 9 apply to businesses. Section 10 applies to customers, in the app, on the web or with a card in Apple or Google Wallet. Everything else applies to everyone. By creating an account or using Perks you accept them.
02Your business account
You must be at least 18 and have the authority to act for the business you register. One owner account creates one business; further locations are added as branches. The details you give us (business name, email, phone, country and address) must be accurate and kept up to date.
You are responsible for everyone you invite to your team and for what they do in your account. Keep passwords private and tell us straight away if you think someone else has access.
03Plans, the free period and payment
Perks is sold as a monthly or yearly subscription. Current plans, prices and limits are shown on our pricing section and in Settings → Billing & plan.
- Free period. A new business gets the Starter plan free for its first six months. A payment method is required at sign-up and you are not charged for Starter until the free period ends. Larger plans are paid from the day you choose them, and choosing one ends the free period. Once any paid subscription has started, the free period does not come back.
- Currency. Prices are set in US dollars and converted to your local currency using a daily rate. The amount shown at checkout is the amount you are charged.
- Renewal. Subscriptions renew automatically at the end of each month or year until you cancel. Payments are handled by Stripe; we never see or store your full card number.
- Changing plan. Moving to a more expensive plan takes effect immediately and you pay the difference for the rest of the period. Moving to a cheaper plan takes effect at your next renewal. You cannot move to a plan whose limits you already exceed.
- Cancelling. You can cancel at any time in Settings. Your plan stays active until the end of the period you have paid for, and you can resume before then.
- Failed payments. If a renewal fails we will email you. After seven days without payment your dashboard becomes read-only until billing is fixed. During that time your customers can still tap to collect and redeem their gifts, while stamping at the counter and spending points are paused.
- Refunds. Payments are not refundable for time already used, except where the law gives you that right. If something has gone wrong, write to us and we will look at it fairly.
We may change prices or plan limits. We will give you at least 30 days’ notice by email, and changes never apply to a period you have already paid for.
04Your cards and rewards
You decide what your cards offer, and you are the one making that offer to your customers. You must honour the rewards, discounts, entries and memberships your customers earn under the rules that applied when they earned them, including after you change or retire a card, downgrade or cancel.
Perks records activity and shows balances. We are not a party to the arrangement between you and your customers, we do not hold value on anyone’s behalf, and stamps, points and rewards have no cash value unless you choose to give them one.
05Your customers' information
When customers join your card you can see their details and their activity with your business. You may use that information only to run your loyalty programme and to contact customers in the ways they have agreed to. You must not sell it, share it with others for their own marketing, or export it to build lists unrelated to your business.
You are responsible for meeting the privacy laws that apply to your business. How Perks itself handles personal information is set out in our Privacy Policy.
06Messages and promotions
Perks lets you send promotions as app notifications, and nearby offers on wallet passes, where your plan includes them. Customers choose, business by business, whether they want promotions from you, and Perks only delivers them to those who said yes. You must not try to get around those choices. Service messages about a customer’s own card, such as a welcome, a reward that is nearly ready or a gift, are part of running the card and go to every holder through the app or their wallet pass.
You are responsible for the content of what you send. No unlawful, misleading, hateful or adult content, and nothing unrelated to your business. When a provider accepts a message, that does not guarantee it reaches the customer’s device or inbox.
07NFC tags
Tags are linked to one of your branches. You can program your own NFC stickers or ask us to supply programmed ones. You are responsible for where tags are placed and for telling us, or removing the tag in your dashboard, if one is lost, stolen or copied. We may disable a tag that is being misused.
08Acceptable use
You agree not to:
- use Perks for anything unlawful, or for products you are not licensed to sell;
- create fake customers, taps or redemptions, or help anyone else to;
- probe, overload or interfere with the service, or access another business’s data;
- copy, resell or reverse engineer Perks, except where the law expressly allows it;
- use API keys beyond the limits and purposes described in our documentation.
09Your content and our service
Your logos, images, card designs and text remain yours. You give us permission to store and display them as needed to run the service, including in the app, in wallet passes and in messages you send. You confirm you have the right to use them. The Perks software, name, designs and mascot remain ours, and these terms do not transfer any of those rights to you.
10If you collect with Perks
Perks is free for customers, in the app, on the web or in Apple or Google Wallet. You need to be at least 13 to have an account. Sign in with your own email address and keep your account to yourself.
- Each card is offered by the business named on it, not by Perks. The business sets the rules and is responsible for honouring rewards. If a reward is refused, please raise it with the business first; we will help where we can.
- Cards and rewards can expire. The app shows expiry dates where they apply. Cards count one collection per day, or per interval set by the business.
- Stamps, points and rewards have no cash value and cannot be sold or transferred, unless the business says otherwise.
- Don’t copy tags, fake taps or share counter codes. We and the business may remove stamps, points or rewards gained that way and may close the account.
- You choose which businesses may send you promotions, and can change that in the app at any time. Messages about your own cards come with them.
11Availability and changes to Perks
We work hard to keep Perks running, but we do not promise it will be uninterrupted or error-free, and we sometimes need to take it offline for maintenance. We add, change and occasionally remove features. If a change materially reduces what a paid plan includes, we will tell you in advance.
12Suspension and ending
You can stop using Perks at any time. We may suspend or close an account that breaks these terms, puts other users or the service at risk, or stays unpaid. Where we reasonably can, we will warn you first and give you the chance to put things right.
When a business account ends, customers can no longer collect on its cards. Activity records are kept as described in the Privacy Policy. You can ask us for a copy of your business data before you leave.
13Our responsibility to you
Nothing in these terms limits liability that cannot legally be limited, such as for death or personal injury caused by negligence, or for fraud. If you use the app as a consumer, your statutory rights are not affected.
Otherwise, Perks is provided as it is. We are not liable for loss of profit, revenue, goodwill or data, or for indirect losses. Our total liability to a business in any twelve-month period is limited to the amount that business paid us in those twelve months.
14Changes to these terms
We may update these terms. For changes that matter, we will email business owners and show a notice in the app at least 14 days before they take effect. Continuing to use Perks after that date means you accept the new terms.
15Law and contact
These terms are governed by the laws of England and Wales, and its courts have jurisdiction. If you are a consumer living elsewhere, you keep any protections your local law gives you.
